CastPlan Terms of Service

Version 1.0 — Effective September 24, 2026

These Terms of Service ("Terms") form a contract between Robert Agarand, operating as CastPlan, a sole proprietor in Calgary, Alberta ("CastPlan", "we", "us"), and the business that creates an account or buys a plan ("Customer", "you"). By ticking "I agree" at sign-up or checkout, or by using CastPlan, you accept these Terms on behalf of your business. If you do not agree, do not use CastPlan.

The short version, in plain words. CastPlan is software that drafts preliminary concrete designs, rebar placing drawings and bar lists. It is not an engineering service and its output is not ready to build. A licensed Professional Engineer must check, take responsibility for and seal every design before construction, and a qualified detailer must check every drawing before fabrication. Our total liability is limited to what you paid us in the last 12 months. Please read sections 3, 11 and 12 carefully.

1. Who can use CastPlan

1.1 CastPlan is for business and professional use only. You confirm you are acting for a business (for example a fabricator, detailer, contractor or engineering firm) and not as a consumer. 1.2 The person accepting these Terms confirms they have authority to bind the business. 1.3 You are responsible for everyone who uses your account, for keeping passwords secure, and for telling us promptly by emailing robertagarand@castplan.ai or using our contact form if you think your account has been used without permission.

2. What CastPlan provides

2.1 CastPlan is a web application that, from a written brief or an uploaded drawing, produces preliminary structural designs, strength checks, calculation reports, rebar placing drawings, bar lists, quantity takeoffs, 3D models and export files (together, "Output"). 2.2 Some features use third-party artificial-intelligence models to read your brief or your uploaded drawings. AI can misread drawings and make mistakes. 2.3 We may improve, change or remove features. If we remove a major feature from a paid plan, we will tell you at least 30 days in advance, and you may cancel and receive a pro-rated refund of prepaid fees for the unused period.

3. CastPlan is a software tool, not engineering — your responsibilities

3.1 Not an engineering service. CastPlan does not practise engineering. We are not a permit holder under the Engineering and Geoscience Professions Act (Alberta) or equivalent laws elsewhere, and nothing we provide is an engineering opinion, design or certification. 3.2 Preliminary and not for construction. All Output is a preliminary draft. It is marked "AI-generated draft — not for construction" and must not be used for construction, fabrication, permits or tender unless and until a Professional Engineer licensed in the place of the project has independently reviewed it, taken professional responsibility for it and authenticated it under the rules of their regulator (in Alberta, APEGA's authentication practice standard and its guidance on the use of AI tools). 3.3 You must make sure that: (a) a licensed engineer of record reviews, verifies and seals every design and every drawing before it is relied on; (b) a qualified rebar detailer (for example an RSIC-certified detailer) checks placing drawings and bar lists before fabrication; (c) soil bearing values come from a geotechnical report for the site; (d) the inputs you give us, including uploaded drawings, are complete and correct; and (e) you do not remove or hide the "not for construction" marking from Output that has not been sealed. 3.4 Known limits. CastPlan's engine is limited to the structure types and methods described in the app and in our published verification report (for example: equivalent static lateral analysis only, no deep foundation design, no post-tensioning). You are responsible for recognising when a project falls outside those limits. 3.5 No claims. You must not describe Output to anyone as "engineered", "code-compliant", "stamped" or "construction-ready" unless a licensed engineer has sealed it.

4. Plans, payment and renewal

4.1 Plans. Plans and prices are shown on our pricing page. Prices are in Canadian dollars and exclude GST/HST and other taxes, which we add where required. 4.2 Subscriptions (monthly or annual) renew automatically at the end of each period at the then-current price until cancelled. We will email you at least 30 days before an annual renewal, and at least 30 days before any price increase takes effect. 4.3 Cancelling. You can cancel at any time in your account's billing page. Cancellation takes effect at the end of the current period; you keep access until then. We do not refund partial periods, except as stated in sections 2.3, 4.5 and 13.3. 4.4 Per-job purchases. A per-job purchase covers one drawing set for one project, with up to three revisions of that project within 90 days. Unused per-job credits expire 12 months after purchase. 4.5 Money-back guarantee. If you are not satisfied with your first paid purchase, contact us by emailing robertagarand@castplan.ai or using our contact form within 14 days and we will refund it in full. 4.6 Payment. Payments are processed by our payment provider (Stripe). If a payment fails we will retry and notify you; if it is still unpaid 14 days later we may suspend paid features until it is paid. 4.7 Free plan. The free plan is for evaluation. Its Output is watermarked and some exports are not included. We may change or end the free plan at any time. 4.8 Early access. While early access is running, every new account gets 30 days of the Pro plan free, with no card needed. It ends automatically, and we never charge you unless you choose a paid plan later.

5. Your content

5.1 You own your content. You keep all rights in the briefs, drawings, files and data you upload ("Customer Content"), and, as between you and us, you own the Output generated for you, subject to our rights in the software in section 7. 5.2 Licence to us. You give us a limited licence to host, copy, process and transmit Customer Content only as needed to provide CastPlan to you, to keep it secure, to fix problems you report, and to comply with law. 5.3 No training. We do not use Customer Content or Output to train AI models, and we use our AI providers under terms that do not allow them to train on it. We may use anonymised, aggregated usage statistics (for example, how many sheets are generated) that do not identify you, your projects or third parties. 5.4 Your promises about uploads. You confirm that you have the right to upload Customer Content, including any drawings or project information belonging to your clients or others, and that doing so does not breach any confidentiality obligation, licence or law.

6. Confidentiality and security

6.1 We will keep Customer Content confidential, use it only to provide CastPlan, and protect it with reasonable administrative, technical and physical safeguards, including encryption in transit and access controls. 6.2 Our service providers that process Customer Content are listed on our Subprocessors page. We will update that list before adding a new provider that processes Customer Content. 6.3 If we become aware of a breach of security affecting your Customer Content, we will tell you without unreasonable delay and give you the information we reasonably can.

7. Our software

7.1 CastPlan, including its engine, templates, drawing formats and documentation, is owned by us and our licensors. We give you a non-exclusive, non-transferable right to use it during your subscription for your internal business purposes. 7.2 You must not copy, resell or sublicense CastPlan; reverse-engineer it, except where the law allows this despite this restriction; use it to build a competing product; get around usage limits or watermarks; or overload or disrupt it. 7.3 If you send us suggestions, we may use them without any obligation to you.

8. Acceptable use

You must not use CastPlan to break the law, infringe others' rights, upload malware, attempt unauthorised access, or send spam. You must comply with export-control and sanctions laws that apply to you.

9. Availability and support

We aim to keep CastPlan available at all times but do not promise uninterrupted service. Planned maintenance will be announced where practical. Support is available by emailing robertagarand@castplan.ai or using our contact form during Calgary business hours.

10. Ending the agreement

10.1 You may stop using CastPlan and close your account at any time. 10.2 We may suspend or close your account if you materially breach these Terms and do not fix the breach within 14 days of notice, or immediately if the breach creates a risk to safety, security or others. 10.3 After your account closes, you have 30 days to export your projects. After that we delete Customer Content from our active systems within 60 days and from backups within their normal cycle, except where the law requires us to keep it.

11. Warranty disclaimer

11.1 We will provide CastPlan with reasonable care and skill, and we will fix reproducible errors in the engine that you report to us within a reasonable time. 11.2 Apart from that, and to the fullest extent the law allows, CastPlan and all Output are provided "as is" and "as available". We do not warrant that Output is accurate, complete, code-compliant or fit for any particular project or purpose, or that CastPlan will be error-free. You are relying on the review required by section 3, not on CastPlan, for the correctness of any design or drawing.

12. Limitation of liability

12.1 Cap. To the fullest extent the law allows, our total liability arising out of or relating to these Terms or CastPlan, whether in contract, tort (including negligence) or otherwise, is limited to the fees you paid us for CastPlan in the 12 months before the event that gave rise to the claim (or CAD $100 if you have paid nothing). 12.2 Excluded losses. To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss; loss of profit, revenue, contracts or business; construction delay, rework or remediation costs; or loss arising from Output used without the review and sealing required by section 3. 12.3 Not limited. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by our own gross negligence or wilful misconduct. 12.4 These limits reflect the price of CastPlan and the fact that professional review is required before any Output is used. They apply even if a remedy fails of its essential purpose.

13. Indemnity

13.1 You will defend and indemnify us against third-party claims, and the resulting losses and reasonable legal costs, to the extent they arise from: (a) Output used for construction, fabrication or permits without the review and sealing required by section 3; (b) Customer Content, including a claim that you did not have the right to upload it; or (c) your breach of these Terms or of the law. 13.2 We will defend and indemnify you against third-party claims that the CastPlan software itself (not Customer Content or Output) infringes a Canadian copyright or patent, and pay the resulting damages or settlement we agree to. 13.3 If the software becomes subject to such a claim, we may modify it, get you the right to keep using it, or end your subscription and refund prepaid fees for the unused period. 13.4 The party seeking indemnity must tell the other promptly, let it control the defence, and cooperate reasonably.

14. Changes to these Terms

We may update these Terms. For material changes we will give at least 30 days' notice by email and in the app. The change applies from your next billing period after the notice period. If you do not agree, you may cancel before it takes effect. The current version and its date are always at castplan.ai/terms.

15. General

15.1 Law and courts. These Terms are governed by the laws of Alberta and the federal laws of Canada that apply there. The courts of Alberta sitting in Calgary have jurisdiction, but either party may seek urgent injunctive relief in any court. 15.2 Notices. We send notices to the email address on your account. You send notices by emailing robertagarand@castplan.ai or using our contact form. 15.3 Assignment. You may not transfer these Terms without our consent. We may transfer them to a successor to our business with notice to you. If CastPlan is incorporated, we may transfer these Terms to that company with notice to you. 15.4 Force majeure. Neither party is liable for delay caused by events beyond its reasonable control. 15.5 Entire agreement; severability; no waiver. These Terms, our Privacy Policy and any order form are the whole agreement between us about CastPlan. If any part is unenforceable, the rest stays in force. A delay in enforcing a right is not a waiver of it. 15.6 Language. The parties have required that these Terms be drawn up in English.
